ALIBABA CLASS ACTION LAWSUIT

Lead Plaintiff Deadline: October 5, 2026

Investors seeking appointment as lead plaintiff must file a motion with the court by this deadline.

Key Details of the Alibaba Class Action Lawsuit (2026)

Alibaba Class Action Lawsuit: Alibaba Group Holding Limited is currently involved in multiple major shareholder class action lawsuits and settlements, most notably a brand new securities fraud lawsuit filed in August 2026.

New 2026 Class Action Lawsuit (Active)

A federal securities class action lawsuit was recently filed against Alibaba in the U.S. District Court for the Southern District of New York.

  • Class Period: June 26, 2025, through June 24, 2026.
  • Lead Plaintiff Deadline: Investors who suffered substantial financial losses have until October 5, 2026, to request that the court appoint them as lead plaintiff.
  • The Allegations: The lawsuit claims Alibaba misled investors regarding its government ties and AI practices. Specifically, it alleges Alibaba failed to disclose that it was affiliated with China’s Ministry of Industry and Information Technology (MIIT), making it subject to U.S. defense blacklists under the National Defense Authorization Act (NDAA). It also alleges that Alibaba carried out unauthorized “distillation attacks” to illicitly copy U.S. AI models (like Anthropic’s Claude) to build its own chatbots, driving stock drops when these actions came to light.

How to Get Involved in the Alibaba Class Action Lawsuit

  • If you bought a security during the alleged class period and suffered a loss, you are generally automatically included in the class. You don’t have to take any action unless you want to file a claim for recovery later.
⚖ Securities Class Action
What Plaintiffs Must Prove

Material Misstatement or Omission
The company made a false or misleading statement, or failed to disclose a material fact that investors would consider important in making investment decisions.
Scienter
The defendant acted with an intent to deceive, manipulate, or defraud — one of the most critical and demanding elements to establish in any securities fraud case.
Reliance
The plaintiff relied on the misstatement when buying or selling the security. For publicly traded securities this can be proven through the "fraud-on-the-market" theory — which presumes the market price reflects all public, material information.
Economic Loss
The plaintiff suffered an actual financial loss as a direct result of the defendant's fraudulent conduct — quantified through expert analysis and market data.
Loss Causation
The company's misstatement or omission directly caused the plaintiff's loss — often demonstrated by a stock price drop after the truth is revealed in a "corrective disclosure." This is the critical link between the fraud and the investor's financial harm.

  • Overall, the notice serves to promote transparency and fairness in the class action process by ensuring that all affected individuals have an opportunity to exercise their legal rights.

Allegations in the Alibaba Class Action Lawsuit

Alibaba, through its subsidiaries, provides technology infrastructure and marketing reach to help merchants, brands, retailers, and other businesses.

The Alibaba class action lawsuit alleges that defendants throughout the Class Period made false and/or misleading statements and/or failed to disclose that:

  • Under the National Defense Authorization Act, any entities directly or indirectly controlled by or affiliated with the Chinese Ministry of Industry and Information Technology were considered a Chinese military company;
  • Alibaba was directly or indirectly controlled by or affiliated with the Chinese Ministry of Industry and Information Technology;
  • The risk of Alibaba carrying out distillation attacks against third-party AI models was not a mere hypothetical or inadvertent, but ongoing; and (iv) as a result, defendants’ public statements about Alibaba’s business, operations, and prospects were materially false and/or misleading at all relevant times.

On June 8, 2026, after market hours, the U.S. Department of Defense allegedly released an updated list identifying Chinese military companies that included Alibaba due to its direct or indirect control by or affiliation with the Chinese Ministry of Industry and Information Technology.  On this news, the price of Alibaba’s American Depositary Shares (“ADSs”) declined nearly 4%, according to the Alibaba class action lawsuit.

On June 24, 2026, shortly before the markets closed, Bloomberg published an article titled “Anthropic Accuses Alibaba of ‘Illicitly’ Accessing AI Models.”  According to the Alibaba class action lawsuit, the article stated in part that “Anthropic said that a campaign by operators linked to Alibaba’s Qwen AI lab targeted Claude’s most prized capabilities, including software engineering and agentic reasoning, according to a letter that the AI startup sent to several US senators and White House officials.”

The article allegedly also added that “Anthropic warned that Alibaba and other Chinese labs are making systematic and unauthorized use of results from leading US models to develop a rival generation of chatbots at a fraction of the cost via a practice known as adversarial distillation.”

On this news, the price of Alibaba’s ADSs fell 2.7% on June 24, 2026, and 4.7% further on June 25, 2026, according to the Alibaba class action lawsuit.

⚖ Securities Class Action
Options That Shareholders Have

Do Nothing — Remain a Class Member
If you take no action, you automatically remain a member of the class so long as you purchased during the class period and suffered a loss.
Exclude Yourself — Opt Out
Upon receiving a court notice, you have the right to opt out by submitting a written request to the court clearly stating you wish to be excluded from the class action.
Submitting Your Request
Your request should include all identifying information — name, address, shares sold, etc. — and be postmarked by the deadline contained in the Notice.
Consequences of Opting Out
If you suffered significant losses you may file your own individual lawsuit. However, if there is a settlement in the class action, you will not be able to participate or share in any proceeds.
